So I have a very old garage which has one of the walls on the boundary approx 7m long. Our house including the garage is being demolished to build a new house. For the Demolishment permit to be approved I require the BA20A form signed by my neighbour. Currently after 5 weeks of negoiation in which i have been happy to pay for the full cost of replacement fence, including retaining wall for a garden bed that was built up 600mm (without consent) being retianed by the boundary wall. The neighbour is unwilling to consent to the demoltion unless the wall can stay.
The problem is the wall in question is 2.9m high and is single skin brick(90mm) upon demoltion of the remaining garage the wall will be strurctually inadequate. It also would not comply with the local council regualtion requiring a brick fence to be max 1.8m high.
As this is holding my whole build process up and costing money, does anyone have any advice on how to progress this? I want to avoid going to magistrate court for a determination. But is it resulted in that does anyoen have a idea on the time frame for this process to happen?
