Browse Forums General Discussion Re: One neighbour objected to reduced front set back 2Jan 22, 2020 8:54 pm McLovin Hi everyone, we're building a house in rural Victoria and have requested a set back exemption of 6m from the street so we can fit our septic effluent field in. House to the left is 7.35, house to the right is 7.71, therefore the average of the two is 7.53, so we are asking for 1.53 difference. One neighbour didn't care, but the other one has made a 'strong' objection (according to the council) and council have asked us if we would consider 8m, and then they would ask the objectors if they have issue with that. I'm not sure why the council are asking us for 8m when we can legally do 7.53, but anyway, that's where it's at at the moment. We had a company do a report and consent for us and a strong case was raised for a 6m set back. Council won't tell us the nature of the objection (would have thought we were entitled to that, but anyway). What are the chances of a successful appeal on this? Anyone with experience on this subject? Thanks. No personal experiences with something this specific but I would be pushing your point to council. What I do find is squeaky wheel gets the grease in these situations. You have as much right to build where you want as mucb as the neighbour can complain, council will be the one to decide. So when a decision is made council will be left responsible for the outcome. Fight for that setback. Hope it goes well for you.
