Then realised we have a leak and possible water under flooring panels on a concrete slab. Called Insurance, builder and plumber. Plumber found the leak caused by staples penetrating PVC hot water pipe in three places in cavity wall behind sink, under window ledge, done by bricky during construction. Photos taken by me and plumber and forwarded to builder. Builder advises he is now talking to his insurance company. Plumber advised that leak became serious after staples rusted out causing leak to accelerate and reason not obvious until now. Cavity and wall boards saturated, damage to kitchen cupboards, flooring affected extensively as water has seeped along slab. So we have consequential damage as well as fixing leak, bricklaying required where leak was detected and repaired, kitchen cupboards will need to be replaced as well as flooring. Slab will need to be dried out as well as wall frames and wet gyprock removed. Is builder liable for repair and damage caused by leakage and replacement of damaged material and labour? Sorry to hear that you have this extensive damage. From my experience with building damage caused by many defects, the builder's insurer denied liability even though they are liable. As you were not aware of the leak and you have sought a plumber to investigate and found cause, you can make a claim through your home building policy. Also claim for the cost of the plumbing investigation report. What State are you in? Your State regulator can also provide you with information if you give them a call. In my case the plumber has been investigated and made to rectify the leak/s including replacement of damaged material and labour costs. I am still battling the builder but the complaint is also sitting with the state regulator for further investigation. Best of luck.
