At the foot of the wall is a drain which takes excess water running through the estate into the storm water. My neighbour has put plants over and in the drain and waters them everyday. To get access I have to go through a gate on his property and he refuses to give me permission to do so. He has caused damage to my garage floor on the inside plus there is the threat of termites and I may need to do maintenance. I'd have a look at your building plan to determine who's property the drain is on. If it's a Body Corp situation, take it up with them. Put them on notice about the damage caused to your garage. If it's not a Body Corp situation, write a letter to the other party confirming the damage caused and asking that they cease the activity. Send it registered post (sign for). If that doesn't help, go see a lawyer or perhaps visit Council as it's a form of nuisance. You must be new to the internet.
