Browse Forums General Discussion 1 May 06, 2019 5:02 pm Hi there i would like someone to assist me with calculating delay cost for completion of house. our contract date of completion was 10th Dec 2018 but now builder has given estimated handover on 15th May 2019. In Contract, it shows delay cost ($28 per day) will be calculated from the date of commencement but does't say until when. the builder says it will be calculated till the date they got the occupancy permit and not till the handover date. So please advise. Also in the contract, there is liquidated damage cost of $ 300 per week. but builder says it doesn't apply to us. pls advise. Re: Delay cost 2May 14, 2019 6:01 pm Hi raj . I think you need legal advice from a solicitor. The $28 dollars is a penalty payable less any rainy days after completion. The $300 is damages that you would incur if they didn’t complete by contract date. I don’t know why they say you aren’t entitled to it.
