Browse Forums General Discussion 1 Mar 30, 2019 4:04 pm Hi all, We're currently near practical completion, with a few bits and pieces to be completed internally. While the driveway and landscaping will also be completed by the builder. Our is land is sloping, and also previously had a swimming pool (it was a knockdown rebuild). Parents didn't want the swimming pool anymore so they hired someone to just break it down and leave the concrete there and fill with soil. We told the builder this, and he advised he would charge $25k to site costs (on the contract) but any extra would have to be charged because he didn't know what to expect with the soil when starting the excavation and site cut. In the end there was extra piers which had to be placed. This was all fine and extra was expected. However, now, the builder is telling us they need to remove 200m3 of soil for the driveway site cut. However, nothing has changed with this aspect of the land since the beginning of the project. Looking over the contract, it says he cannot seek additional funds if it could have reasonably been ascertained had the builder obtained all foundations data required under the act. Any thoughts? The problem is people make (reasonable?) mistakes and you should have verified the data & proofs beforehand Here's my top list 1.The salesman made a mistake. ie basically he's not qualified ? 2.The tradesman made a mistake, ie he no longer works for us? 3.The builder " that is a variation, i am not an engineer" ie, talk to a lawyer etc,etc Sorry to say either way you are stuck with additional costs and delays OT, the pool should have been removed Designer,Engineer (Civil,Const & Envir),Builder,Concrete & Masonry Contract.Struct Repairs Re: Extra costs for driveway site cut 3Mar 31, 2019 9:03 am StructuralBIMGuy Sounds like you should have done a bit more research on site works & costs? Re: Extra costs for driveway site cut 6Mar 31, 2019 9:32 am You'll need a complete analysis of the data on the siteworks, Contour, Geotech report, details and cost breakdowns, before and after you signed the building contract, the courts rely on "Proofs" & data Ill try to put up a Bim siteworks example when time permits. hth Designer,Engineer (Civil,Const & Envir),Builder,Concrete & Masonry Contract.Struct Repairs PM me your email. I have a build excavation calculator you can use based on your plans to double check what your builder is telling you. Cheers Simeon 1 10244 I am not sure whether Perth has its own way of doing things in regards to this. Most of Perth has class A (sandy soil), except for some areas near rivers or hills. 2 13099 Is anyone building with Mojo and have a recent site cost tender 0 15952 |
