My wife and I bought a block two years ago which was subdivided 6 months earlier and a restricted building envelope was put on the title. I have a copy of the plan of subdivision and it states "The registered proprietor shall not construct any dwelling or garage outside the area hatched in the schedule; My question being: Do eaves have to be included in a building envelope? I rang the council and someone unconfidentley told me they were. Is it an individual decision set by each council or is it the same for every council? If they are allowed to protrude from the envelope where would I get this in writing? I was told I had to apply for a planning permit for it to be altered and it would cost me $510 and of course could still be rejected. I don't want to have to pay this cost if they are allowed outside the area. Many thanks. Bailey. I'm building in Mitchell Shire (Vic) and if we were having eaves they did not have to be in the building envelope. But I am not sure if that was a council decision or an estate decision.

So that's something.
