Browse Forums General Discussion 1 Feb 19, 2019 10:31 am Hi my bathroom floor has water damage l discovered a few months ago. l made an insurance claim but it was rejected because the insurance company said it was due to faulty workmanship by the company that built the house didn't put silicone along the floor and behind the taps, a separate builder inspector who had a look also said the same thing that its the building companies fault. The problem is my house was built 8 years ago and the structural warranty is 7 years so l am one year expired. The booklet the company gave me said no claims after 7 years will be accepted by them. Two plumbers , the insurance company and a building inspector all said the damage is the building companies fault so l feel angry if l have to pay for it. l plan to send in the building inspectors and insurance reports to the company that built my house, but if they refuse to pay for the damage because they say the warranty expired or for any other reason do you have any advice on what my rights are or what l can do,.l live in Victoria. The Building Act 1993 allows action to be brought against a builder for up to 10 years from the date the work was completed. This right transfers to a new owner if the property is sold within this time. For more information, seek legal advice – including if the building work is older than 10 years.
