Browse Forums General Discussion 1 Nov 18, 2018 12:49 am Hi all My next-door neighbour is asking for permission (adjoining property owner comment form) for the plan for building of their garage/store extension. Since my garage wall was built at the boundary, their paraplet wall would be almost 0 distance from my garage wall, which is fine. However, from the drawing provided, the length of the store/garage extension would be longer around ~1.5 m from the backside of my garage, or 1.5m of the fence area. The problem is that my bedroom is located on the back of my garage with windows facing to the fence (distance from window to the fence around 1.5m), so the paraplet wall (~34c) would block my window for about 1.4m, since my window facing East, it would definitely be blocking the sunlight to my bedroom.(p.s. my home is single storey and the neighbour is double storey). Can you please kindly advise for my situation? Much appreciated for all the advise. Regards Van_De_B WA Re: Neighbour paraplet wall? 2Nov 18, 2018 10:19 am Has the communication come to you from your local council? If so it's just a matter of pointing out your objection. They will be quite capable of assessing if it's valid and if necessary requesting your neighbour to change his plans Re: Neighbour paraplet wall? 3Nov 18, 2018 12:01 pm Thanks Althom The neighbour come to me directly and pass me the Adjoining property owner comment form with the drawing plan of the extension. I already put my objection to the proposal in the form and signed it. My neighbour seems unhappy with my position, so let see how it goes. To be honest, I'm not against their plan, as long as the wall is not blocking my morning sunlight. cheers Re: Neighbour paraplet wall? 4Nov 18, 2018 12:51 pm Van De Bosch To be honest, I'm not against their plan, as long as the wall is not blocking my morning sunlight. Neighbour can be as unhappy as they like but they have to comply with the regs Thanks Althom Re: Neighbour paraplet wall? 8Nov 19, 2018 1:54 pm If the neighbours house is double storey then it’s going to block the sun anyway isn’t it? Have you actually worked out the path of the sun for every season taking into account a rising or setting sun will be blocked more by adjacent buildings/obstacles/trees than a Northern sun will? If indeed it’s Easterly sun and you’re in WA, why you’d want it directly into a bedroom is interesting. I’d fully understand your concerns if it was a North facing living space that was potentially going to be overshadowed. Just an opinion, no offence intended. Re: Neighbour paraplet wall? 9Nov 20, 2018 5:39 pm The house itself would have to be set back from the boundary with 2nd storey set back further under WA regs to avoid overshadowing. This is an extension of a wall on a boundary. Can't see it being allowed to shadow a habitable room if that's indeed what is going to occur Re: Neighbour paraplet wall? 10Nov 24, 2018 12:40 am The wall height is under 3.0m so I think it will comply. Windows from habitable rooms are set back 1.5m exactly for this reason. Unfortunately I don't think your concerns will prevent planning approval.
