Browse Forums General Discussion Re: FRONT HOUSE SETBACK DISPENSATIONS ? 2Apr 28, 2018 9:41 pm Ours is 2 storey, and you need to understand what an allowable encroachment on a setback is, basically, you can have a porch or verandah in front of the front wall of your house as an allowable encroachment, there is a height restriction on allowable encroachments (I think 3m), so you cannot have a balcony as an allowable encroachment. We had to remove most of the balcony on our design. If you want you can try and and put in an application for report and consent with your local council, but I would speak to them first to see if it is likely they may consider it as it takes time and a few hundred dollars. Are you set on your house design with the balcony? You could ask the builder to remove the balcony from the facade, or you could look for a new house design. The shallowest 2 storey house designs I found from builders that built in my part of Victoria were the Metricon Trentham or Winchester, Simonds Stanten, 8homes Java and Mode, Dennis family Sapphire and Topaz. If it is 2 storey there are 2 things that could have happened. 1. The owner applied for dispensation and it was approved 2. A private building surveyor has signed the building permit even though it does not meet regulations - this is probably more common than you would think. In my area the council recently changed the zoning, we did the 'correct' thing, applied for dispensation, and got our application declined by the council. However, there are a lot of houses being built that do not meet the new regulations that have had private building surveyors issue building permits, and I queried with the council, these builds do not have dispensation. In theory, the council could ask people to tear down the non compliant parts of their building. In reality the council does not have the resources to check all builds and are only likely to investigate if they get a complaint. The building surveyor issues the building permit and occupancy certificate. They are supposed to make sure the building is compliant with relevant building codes. I would still hire a private building inspector to check the quality of the work. A competent consultant will also be able to provide the building lawyer with a technical understanding of the building project. Search for building consultants online or in the telephone directory. Check they are qualified and experienced in the type of work you are undertaking (for example, two-storey timber-framed construction), and have insurance that will cover you for the type of work they are doing. Inspectors/building consultants aren’t necessarily registered so do research and choose someone with many years experience in building and/or qualifications. Use an inspector to have someone helping you check quality and standards are met like walls that are straight and fire standards that are met.
