I have built a brand new home on the south coast with a reputable builder. They were responsible for all the certificates and inspections under the contract. I built the house primarily for retirement in a few years but to use as a holiday rental in the interim. We were handed the keys just after easter last year but needed to get some landscaping done for drainage and finally arranged the final inspection before Xmas last year. the council were our certifier and they found that no frame inspection was done with my builder and wont release an occupation certificate. Therefore I have paid insurance - which I have been told is invalid and been unable to rent the house out due to the insurance validity. Also I have been told that we should not be using the property at all but we have done a total interior fit out ready to rent out and have stayed several weekends whilst working at the property. this is causing me major stress and has also lost us potential income. What can be done??? Can I sue the builder? will the council not issue a certificate until they can inspect the frames which may mean removal and reinstatement of internal walls? Assuming that you had a private certifier inspect the property during the different stages of build to issue the appropriate certificates other than the frame? Can you contact the private certifier directly to see if there is an oversight on their behalf? It's important to try and get a final occupational certificate, because you would need to provide this if you ever sold your home. Council can make a stance and stop any one living in the property, worst case scenario. If Council was PCA, what is their advice to resolve this? After 12 months its deemed occupation, but may have issues with insurance like you mentioned.
