Browse Forums General Discussion 1 Jan 17, 2018 5:48 am Like many others including the ACCC, I believe the validity of review content posted on the 'Product Review' website is questionable and is unable to be substantiated. Below is a question posed to Metricon via Product Review' - of which they are a subscribed 'brand management' customer. I will await their response - Hi Metricon, The following review was posted in the review section of this website 3 days ago. It has not yet been approved to go live. Please explain why. Is there filtering out of negative reviews? If so, by who?. We are two thirds of the way through the build and have identified significant structural defects in the house. Many elements do not comply with the tolerances in Australia standards, and there are differences to the contract plans. The slab is not level, the walls and ceilings are not straight, the brickwork is sloppy, the waterproofing is defective, and the site drainage poses a significant risk of slab heave. After dismissive and unsatisfactory responses from Metricon's senior management in NSW over the past 2 months we have involved NSW Fair Trading and are now awaiting their inspection. Has anyone else had a similar experience mid build? How do you resolve these problems? Do you have any suggestions to assist us and your senior management in NSW to rectify the defective workmanship? Yes, We have an investigation report from building inspectors Houspect, are following the dispute resolution procedure in our contract to the letter, as well as asking NSW Fair Trading for assistance. Metricon are legally obliged to build all houses to Australian standards, of the workmanship displayed in their display homes, and as per the contract design. We are obliged to pay Metricon the progress payments when the stages have been completed properly as per above. This is an unusual and fortunate situation because we have identified the problems early and Metricon has the opportunity to fix them before the fixing stage progress payment is due. It appears most customers don't identify the defective workmanship until its too late. Despite their tactics to 'push on' and cover things up, they cannot continue building without fixing fundamental defects like straightening the frame, for example. If Metricon can't produce a written plan of how they will fix the defects then this will be considered a breach of the contract and we will take the appropriate action.
