We have requested for 'canopy' range hood at the start of our build and not the slide out range hoods that you usually see in apartments/hotels. There is a written note on the side of the contract on the kitchen page and it was signed by the builder during the contract stage. I have also got email proof that we will be getting a canopy range hood in an email communication during the kitchen colour selection. However, our builder has argued that because the request/variation is not added into the 'notes' section in the contract then it is not legally binding. Is my email and notes on the side of the contract legally binding? Thank you and much appreciated.
