I live in Victoria in the Council Area of Maroondah. In my fully detached House towards the rear of the property. There is a neighbors garage which has been built on the property line. This is a brick structure which has been in place for some 35 years or more. Well before the time I moved in. There is also no wooden fence separating our properties next to the garage. Just the brick wall on the property line. As you move towards the front of the property there is an easement which is a communal drive way for the multiple residents on their side. There is a wooden fence past the brick garage that divides our two properties. I have about 1 or 1.5 meters clearance between my house and the fence line. Okay, now here is the deal. I have been informed the Neighbor wants to convert the Garage into a bedroom. Putting the new bedroom wall onto the same property line as the old garage. Are they allowed to do this? When I was doing a house extension many years ago. My house needed to be at least 1 meter away from the property fence. There was no if's or buts about it back then. Why is it that the garage which is being planned to be converted into a bedroom, now being allowed by the Council? I don't understand the reasoning behind this. As other already mention, no matter your neighbour is on boundary or behind wooden fence with 1.5m setback, there won't be any significant difference in noise level from your living area. At the end of the day, you will be the one that needs to control the noise level. It just that your neighbour's garage was acting as a sound barrier before but that doesn't mean that you can go over your noise limit. I'm starting my build soon and with Maroondah council as well. As long as your neighbour is not taking down the garage and only converting internally and meets all NCC and regulation requirements, council will grant them the permit even if you object. I have approached councils in the past and got helpful information." Council's policies can also change and affect well meaning forum 'advice', whatever advice you receive from a forum needs to be checked and in your situation, that authority is your local council.
