'shall not construct side fencing along the reserve boundary with a height greater than 1.5m & with a minimum 50% visual permeability' seems odd to me, but keen for any feedback. You're supposed to be able to keep an eye on the park/reserve etc. so you can report any non appropriate behaviour. Just never seen this type of covenant in a subdivision before. We are thinking that we can deal with it, but not straight forward. Re: Fencing Land Next to Reserve 7Jul 04, 2017 9:51 pm It is an option. Convenants are only enforced if each title holder passes on the covenant with each sale. The law does not make it obligatory, but passing it on is usually part of the contract with the developer who is enforcing the convenant. Usually after the development is complete and the developer is gone, they lose interest in enforcing convenants, and people do drop them when selling if buyers dont like them. Tell them you dont want it and see what they say. If it was me I would not take it on. . Id want to have a 6ft high fence at least to keep people out. Remember you cant control who uses this area 24x7.
