Browse Forums General Discussion 1 Jun 05, 2017 5:25 pm Hi All, Newbie here just want to post general question about contract - have you seen any builder (if any, at all, really) with fair building contract? I know from reading for example some builders use Alternative Solutions viewtopic.php?f=3&t=83571, some other use alternative progress payment method viewtopic.php?f=31&t=24691 (I know this one is a 2009 thread, but I think it's still relevant). Both of them are not exactly favourable for us as the customer. Have any one of you actually had your contract reviewed and your solicitor/lawyer said that it's a good contract? I'm asking because we bought apartment off the plan before, and I got the contract reviewed by 2 different solicitors (not because I was being super careful but because we had an issue with the first one). Both of them said the contract is good, although still favouring the builder obviously, but it's quite fair to us as the customer as well. I'm not sure if anyone has similar experience with building a house, where the contract was reviewed and the solicitor mentioned it was quite a fair contract. If you do, do you mind sharing the builder's name and the suburb you're building in? I'm based in Melbourne, planning to build in Wollert. Yeah I know a lot other off the plan contract sux big time, just saying that we somehow managed to get a relatively fair one. Still needed changes here and there but nothing major. From what I've read here most home builders' contracts are very unfair to the customer. Do you know of any builder(s) that use standard HIA or MBA contract?
