Browse Forums General Discussion 1 May 04, 2017 12:35 pm Recently purchased a country property with a dwelling, on 2 acres in a farming zone with one road frontage. It is amongst cattle and sheep grazing farms with another block of about the same size with a house on it, adjoining mine.Apart from this neighbor the nearest next house would be a kilometer away.According to the neighbor the 2 blocks were subdivided some 15 years ago and fenced with post and wire.She built on hers about 13 years ago. I don't know when my block was purchased,but the person I bought it off had commissioned a fairly big well known rural builder to build this house on it around 10 years ago. My block is now well established,thanks to the original owner with nearly all lawn with a vast array of fruit trees along with ornamentals around the boundaries and around the house itself.Because it is in a farming zone a planning permit along with a building permit is required for any additions or outbuildings I wish to construct. Being a fairly new house I was able to obtain the original plans and permits soil tests etc for its construction.Bonus I thought,all I will have to do is to add to these drawings and comply with the same structural requirements.Took my proposal to the council and was told I will have to have a land survey done. Had the survey done irregular shaped block($2000) and to my surprise all of the fencing was spot on apart from the road front fence which varies in and out along the length of it (around 180m) up to 7000mm.Where the house has been built,facing this boundary, the true survey line is around 6000mm IN from where the post and wire fence is.Looking at the site plan,which looks like it has been taken off the title plan, the house was to be constructed 17000 in on one end and 11000 in on the other end. Well when I have measured it it is 17000 and 11000 in from the fence,( which is still at least 15000 in from the road which has been cut thru and around 3000 down) therefor siting my house is only 11000 and 5000.,yet looks like to all 17000 and 11000, with all the established trees and plantings etc,even the water tank encroaches this area by 300mm.The builder has obviously taken the fencing as the boundary,and not surveyed the land prior to building.I don't know if the original owner knew of the stuff up, got a gut feeling he probably did, but it is my problem now and if i wish to build a shed or anything on the property,the council will find out and i don't know what the repercussions could be. I cannot adverse possession this section as it is council,or government land. Any advice appreciated.
