The issue i have at the moment is my neighbour has built his house just the slightest bit higher. There is a very small slop that goes down into my front lawn which is all flat. Now i have already received my occupancy certificate through a private company. He has been rejected from council who have apparently told him there must be a retaining wall installed. He has told me i am responsible to install the retaining wall and has been bugging me to pay for it (no offer to go halves). The way i am seeing it is i have already received my occupancy certificate why would i have to fork out money for him to get his certificate? We had to do retaining walls either side of our house due to a site cut. Our land is slightly higher than our neighbour and the engineers have said we need to build a retaining wall to stop our neighbors land from being flooded. It is costing us $8000 but we are doing it as we can't get approval otherwise. Re: Retaining wall responsibility 5Feb 16, 2017 9:49 am I'd suggest, with respect, that he should pay. I know in some places a RW is not considered a fence and it must be built to one side of the boundary line. Perhaps with "fence" on top. But - if done - it is that persons retaining wall. You should pay half the actual "fence" cost. I take it we are talking a reasonable size ? Also - what is he going to use - stone / wood / metal ? I don't know where you live - but again - I'd check with Council on the matter. Or google it to see what "laws" apply.
