Browse Forums General Discussion 1 Feb 06, 2017 12:24 pm Hi Everyone, We vacated our rental in August last year and the Real Estate Agent have attempted to deduct $800 for paint depreciation. We went to pre-trial as I was adamant that I was not liable for this cost as we had been in the rental for 4 1/2 years. The owner is claiming that the walls were painted prior to us moving in 2012 but I have photos of the condition of the walls when I moved in. They use the word chips we use the word flaking as the paint is literally flaking from the walls. I used to work in the painting industry and it is so evident that no sealer was used to prime the wall as you can see the white set underneath. I have the court case next week and I want to prepare for the judge and have a diagram or some form of evidence between a correctly sealed wall and one that has not been sealed correctly. Anyone in the painting industry that can assist me with this? Below are the photos of the walls in question. At the owners expense. They'd claim the usual benefits etc etc. When you sell a house I'd doubt many would do a repaint - regardless - unless it was just a specific area. You may need a statement from a "professional" who has seen it in person. Maybe a stat dec or the like. Might cost $50/$100 for their time. I know houses that have been occupied for 50 years and the interior paint is still very good. Having to paint every 5 years suggests you have crap tenants who are abusing your walls. Don't owners claim depreciation every year in their tax ? If I was renting I'd want a fresh and clean house. They've dragged this on since August last year when we moved out. The owners daughter now lives there AND they have repainted.... so how in the hell do I prove the above. The walls that have the damage are they in or sharing a wall to bathrooms or are they walls that back external walls where there is moisture? In the first pic it shows a pre existing patch where there is a fresh coat of paint over the top? Proving it was an existing problem. The member at the tribunal hearing the case will be fair and reasonable and from my experience this is an issue with the property and not a tenant damaging walls. Before you rip it up, if you can in the grout lines, drill some holes and pour/inject techgrip by sika. I have used it to bond mdf to timber, but in the process it dripped… 1 4286 Not much in this responce. My suggestion is, what are you looking to build and why.
