He called me up yesterday and asked politely if we could think about allowing him to build the retaining wall 6cm approx into our land. He said the reason for this it will be cheaper for him as he wont have to excavate as much dirt etc. He said the retaining wall will be 13cm in width (Concrete sleepers are 10cm and the frame 3cm). Im leaning towards saying no as this can become a headache in the future if selling the house. Also is this like a handshake agreement or do you need to sign a paper? Just wanted to get everyones opinions and pro's and cons about this. Thx! Whatever needs to be done he should do within his own property bounds, and to request encroachment onto a neighbour's land is not recommended, as a rightful refusal may offend. However if this is located on the boundary line, thats different, you should check the Fences Act relevant to your state. A retaining wall , integral with a fence, is often considered part of the fence. Im not sure that he us required to put it on his land? I guess since you are neighbours on sloipng land you have a shared obligation to address this issue? Never do anything by handshake. - those days are long gone. Get everything in writing. The bench looks higher than 1000mm to me, so the developer should have possibly put retaining walls in as part of the DA. Check the DA conditions with council. Thank you again Simeon..
