Browse Forums General Discussion 1 Oct 12, 2016 9:21 am New neighbours came to us and asked if we could hold of building a fence to a certain point and asked if it was ok to build to the boundary – basically put their garage wall on the boundary. I didn’t see an issue and they assured us it would look nice. Personally as long as it’s a normal brick wall – no issue. So I build the fence as requested and waited and waited. After months of nothing finally got hold of them and asked what was happening and they advise a start date in weeks, BUT their builder apparently is required to remove our retaining wall. Over $10,000 put in on months ago to be removed and the owner says to sell it on Gumtree. Obviously this is really poor as I would get next to nothing and be stuck with the bank debt with no wall. So I said that it would be ok if we were able to recover most of the investment. A few weeks later I spotted some surveyors on their land and said hello. Turns out they said, they were hired specifically to survey our wall is to see if a faction was in the neighbours boundary as they were looking to have it removed by force – Lovely and very disappointing but kept it to myself. Then again months and nothing from the owners as we suspect they were altering their plans. Then one day they started earth works I have spoken to their builder several times (Fairmount’s) who are generally rude and don’t want to talk with me around issues. They say the owners should be talking to us and in part this is right, but fat is they are not. The neighbours have raised the ground level in one section and I have decided to raise the retaining wall myself as it is a few hundred buck and not worth the months of waiting. We have had concrete from the foundations of the neighbour poured down our storm water pipes. I had to have the council out as the builder decided to use our house as a brace – not asking of course Constant theft of items outside Using out backyard as their toilet And now I have been trying to find out about the wall which it appears will not be racked to look nice – like a normal wall. So for months we have lived without finishing our side off with paving, trespass, damage etc. and no communication. And this all boils down to a neighbour who is upset off we wouldn’t through away $10,000 of walls and we are the apparent bad guys – it is pathetic. So overall have reached a point where they as people are not worth anything, but don’t want to get stuck with the unfinished wall which in reality when it is being done at the time will be so easy to rack. It is the oddest approach to me for people to treat others like this. Imagine if I was nasty and your building next to me – imagine what I could do !!! If I was you, you should be getting in touch with THEIR building surveyor. They should have issued you with a protection works notice if building near the boundary.
