To get to our lot, there is an unsealed road from the main road which passes by 3 other lots. None of the four lots has been developed yet, but the existing unsealed road is being used by the public to get to the nearby beach. Council has requested that we construct a bitumen sealed road to our property. I asked why is it that I have to pay for a public road that will provide access to all my neighbours and to the beach. The response Council has given is: Council's Engineers have indicated that as you are the first to develop the vacant lot at the end of the street you will need to bring it up to this minimum standard. Then given that it is a dedicated public road, all general public have the right of usage. The engineers have indicated that you have been given substantial concessions with the standard required. If this subdivision was a new subdivision, the road width would be substantially wider and concrete kerb and gutter and potentially a footpath would be required. Do I have any other option other than constructing the road or waiting for other owners to start development? Where can I read more about the legislative requirements? Many thanks This was on google.
