Browse Forums General Discussion 1 Sep 12, 2016 8:45 am Hi guys, Getting to the pointy end of the build and the builder is about at the end of our contract time line but there is still quite a few weeks work to go. I was reading the HIA contract section 19 which is about builders claiming delays in the build and them having to give notice within 10 days of the event etc, but of course our builder has a special condition that nullifies the HIA condition and it says that they can claim 1.5 days per wet day at the end of the contract based on historical data. We should have pushed this issue more from the start to have it removed or made more specific but we of course thought they were capable of building a quality build within the 26 week time frame. My question is, can they claim as little as 1mm of rain as a wet day? We really had no rain before the house being enclosed and i have looked through the historical rain data for the area and confirmed this. So i am wondering if we can do anything or is it too little to late now with regards to there having to be a realistic amount of rain to actually delay the building works?
