Browse Forums General Discussion 1 Sep 08, 2016 10:41 am Hello, all, I am building house with Metricon at the moment ( near the completion of lock-up stage ). However, Metricon told me they made a terrible mistake with overshadowing plan and my house is 300mm higher at back corner and blocked the sun light to the neighbor. Metricon is preparing new design at the moment to be compliant with regulation. The possible solutions are A) cut off some eaves. B) redesign one or two bedrooms to be compliant. Since it is 100% Metricon fault and it changes the house what I want, I am entitled to ask for compensation from Metricon. The question is how much discount I should ask for. I don't want to give Metricon a number which is not realistic and won't happen. So I need input from everyone how much discount is reasonable. For example, 5% discount or something else. Redesigning the bedrooms doesn't sound ideal, the eaves solution may be better. You might be able to get them to include something that would normally be an upgrade rather than discount the price. Considering the inconvenience and hassle Metricon has caused to me ( I have been hassled by this terrible mistake for a couple of months and there is no sign when it will end ). Also cutting off the eaves will make the house look very ugly. I will definitely not sign on new design with thousands of dollar. Council will probably need to compensate your neighbours for their mistake but if you've got prior approval it would be a bit rough to reverse it now Re: How much compensation should I ask for 9Sep 09, 2016 10:55 am the house is at lock-up stage now. the building plan is endorsed by the Metricon's surveyor which is called GROUP FOUR. The problem was found near the end of lock-up stage. This problem has been put forward to council now. Metricon, GROUP FOUR and Council are discussing. Since all of these problems are caused by Metricon, how much compensation I should ask for? what would I do if Metricon refused to compensate? The appeal may or may not be successful but its worth a try. The appeal may or may not be successful but its worth a try. will it override the decision made by council? currently they are talking to council. not sure whether the appeal will override council's decision. Take a breath and wait to see what the council says. If it's the house you want that was originally designed, then push for the Appeal if it ends up not being in your favour. Otherwise you look like a money grubbing dbag. The longer it takes the more liquidated damages you claim at the end for going over contractual periods. Win win. The response will be to wait out until a solution is offered, discuss/negotiate, then if not happy to contact them again. It is literally 100% a waste of time at this point. I'm not surprised some people have terrible experiences. Typically its people who stress and jump up and down because they've not followed a logical order to dealing with issues. "My frame is overhanging, I better get a lawyer involved" or " the paint job is poor, I'm going to go to vcat" Settle down people. Have an adult conversation, fact check the offered solutions, make a decision if you're happy with the offer, THEN go back and renegotiate.
