Browse Forums General Discussion 1 Aug 01, 2016 10:11 am Hi, My daughter and boyfriend yesterday afternoon signed a Quotation Letter of Offer in Ballarat Victoria. Quotation Page One lists their names and address, Summary of the costs involved and a cost breakdown on the attached pages. Base House, Optional Extras and Total Site Costs listed along with "Total House Price". From my research this "Quote" is now considered as a Domesitc Builders Contract and therefore very similar to a Building Contract and so this means they have a five day cooling period now, not when plans are draw up. I little confused... My main concern is that the Quote does not provide details of ; 1. Builders Insurance 2. Start and End date for works 3. How payments will be made to builder ie stages and dates etc 4. Delays allowed for weather.. 5. That contractor has accepted that work cannot commence and therefore be completed till their block is titled. 6. I wish to get more info on the Builder too ie references and view some of the homes they have built in the last 1-10 years They advice I seek is should I spend the cash and send a copy of this document to a Building Lawyer asap? and not wait till the "Building Contract" is drawn up? Sales Rep mentioned that they are not signing building contract today as that contract is 100+ pages... ? Any advice would be appreciated. Thank you. But clients would get sick and tired of cost blow outs/ sticker shock as salesman would call it and they would walk away. Now clients can avoid this by getting their own plans drawn up ,include all preliminary engineering, siteworks, ask questions on H1 in order to make informed decisions, etc and then get 3 builders to quote. Thus comparing apple with apples... The Act is on line so read it. The salesman facilitates the process by telling the clients whatever they want to hear for which they will receive a huge Commission 2-3% once contracts are signed, here in WA designers & design brokers are required to disclose these hidden commissions and most don't offer preliminary engineering...Why, because builders that quote on their plans like to keep the engineering up their sleeve ...so as to speak BEWARE.. I am seeking information from a Building Lawyer on this matter and also I found out that they only signed the top page of the Quote as there was no where else to sign?? however, they have paid a deposit....$2,000 so that's why I am seeking legal advice to ensure that they get full information in the next day or so. Paying the deposit can possibly mean in Victoria, a Domestic Building Contract. I'm hoping not. I just don't trust anyone! They do wish to go forward with the build, but I need them to have all details .. as we know ... GST .. Payment dates ... Start End dates ... etc etc. I will post update when I can with the outcome. Re: Quotation Letter of Offer-Same as Building Contract? 7Aug 01, 2016 4:47 pm Hi, I decided to phone Company citing under "due Diligence- prior to entering a Contract" made enquiries about Builders Rego Number, if a HIA Member, Insurances etc. Manager was helpful, however was confused that I would have a quoted price. . He is now sending me the Notes and Inclusions of process steps. He stated they use a HIA contract (they are registered with HIA) He also quoted me info on progress payments which appear to match VBA and Consumer laws. Feeling a little better ....
