Browse Forums General Discussion 1 Jul 30, 2008 8:43 pm Well after my initial scare today with my stairs, I have just had another HUGE scare (well technically it is still scary until I find out what is happening) I just received our paperwork from the lawyers about settling on the house, and they mention that we have an easement on our land....no biggie I think, I knew we had one running across the back of our property which won't affect our build, but oh no, this one also runs along the eastern side of our property and is 6 feet (1.8m wide) First I freaked out and though well there goes our house build, but then I settled and looked at our plans, turns out PD have sketched our house as being exactly 1.8m from the eastern boundary (so technically we are not building on the easement, but very close) I have emailed council to see if this is a problem. Then the next problem occurs, I look at our plans again and notice that PD have said we will have 1.8m on the eastern side (right hand side neighbours) and 1m to the left hand side neighbours, this is where the garage will be. Council have said we can build the garage to the boundary, or 1m + from the boundary (nothing in between apparently) When I add this up PD is saying we have 2.8m of space to play with between boundaries, but guess what? This is incorrect. Our land size is 15.24m wide, our house is 12.52m wide so we actually only have 2.72m of space to play with. This means that the garage will have to be built to the boundary as council will not allow us to build .8m from the boundary, and that there will be 2.72m of space between us and our right hand side neighbours (this solves the easement problem atleast) BUT the problem now ****** in whether PD will build the garage to the boundary!! I recall someone saying they refused to do this. So if they refuse I can't build with them, our house simply won't fit Why did I not notice a) the easement and b) the incorrect measurements before I purchased the land!! And on here everyone thinks I am so organised I have left messages with the council and PD to see what they say, please pray that this all works out for us!!! Sorry to hear this news. I can't help with the boundary thing but in this thread of Annoyed's PD ARE building the garage ON the boundary so if they are doing it for these clients then NO reason why they can't with yours. I have definately seen a few cases where PD have built on the boundary so I know they can do it, I just hope it doesn't add a truck load to the budget!! Also does anyone know if having an easement on the property affects the demolition process? Demolition shouldn't be a problem with the easement I thought they needed to be taken into account when building? The only reason that I can see for their reluctance is that if this is a built up area, which it sounds like it is, they may not be able to access the wall from the "outside", as they'd need access to your neighbour's land. Instead, they would have to build the wall from the "inside" of your garage, making it harder to get a good finish to the exterior. I guess God didn't use subbies... Everyone has made great points. I didn't even think of the exterior of the garage Mr T - I hope our neighbour is easy to work with. Their house is very 'unkempt' to put it nicely, overgrown front garden, broken fence....I'm thinking they are either quite elderly/unable to care for it or they are just untidy We were actually going to suggest to them that we put a new fence up anyway, we'd just pay for the lot, seen as though there is already a fence there, so I might put that to them.... Rellie - thanks for your help, I'm a bit more positive now that I got over the shock of it all last night Anyway I spoke to our CSC who is great, she said they can build the garage 200mm off the boundary (so pretty much on the boundary) and that will leave heaps of space on the other side for the easement, hopefully council and the neighbours are ok with this, won't find that our for a few more weeks I doubt My karma ran over your dogma Re: I can't believe it!! 15Jul 31, 2008 9:56 am The problem you are going to have is that with building that close to the boundary you need to create an easement on your neighbours land for access and mantainance of your wall.
Its usually 900mm wide although lately i have seen it reduced to 750mm. It has to be registered and put on title i believe. Usually not a problem unless your neighbours reject the option. It will just take time and off course $$$. On the building side i cant see why PD will charge you more. Hope this helps....... I dont think they will organise surveyors, get linen plans and 88b instruments drawn up and lodge wth the Lands Titles Office.
I would give your council a call and ask the question of what process you have to go through. Ask them do you need a matainance easemement if you build that close to a boundary. If "yes" then ask what you have to do. You may find it easier to reduce the width of your home to suit your block. In my opnion PD should of picked it up and made you aware of it. We are building garage wall on the boundary and haven't heard of any of this. (in SA though). We were not charged any extra to build on the boundary and I can't see why you should be. Not that easy to reduce the width of a house that is only 12.5 m wide. I am presuming you are haveing a double garage in which case almost half of the first story width will be garage. Not sure if SA is any different, i'm in NSW. Have a look on your title or Dp plan and on the block next door there should be an easemnt for maintanence or similar shown. Is the same if you are on the boundary or close to it ( in this case the wall is 200mm off the boundary if there is a gutter well then you are only going to be 20 or 30mm off the boundary. Cause the measurement is from gutter not wall ) And this is why the easement is required. If you have a blocked gutter or blocked weap holes for example. How do you clean them?? A crack in your wall. How do you fix it ?? Helyn - Your right we are having a double garage and can not easily reduce the width of the house.
