Browse Forums General Discussion 1 May 21, 2016 12:37 am I am struggling to find legal information on who is responsible for damage to my Boundary Wall, one wall of our home is currently acting as a fence and has been damaged by our neighbour's. They have installed a garden bed along the wall, causing damp damage because it was drained properly. Furthermore they have damaged the render by throwing things against the render. When speaking to the neighbour their reasoning is that it is their property and they can build what they like against their 'fence' ... Problem is it isn't a fence, it is our home. Furthermore we really wanted a fence install, that would have encroached their land by a few mm to avoid these issues. Does anyone know my legal rights. I can't find anything in the Fencing Act that protects my home. Is there another Act I should be searching for? Re: Shared Boundary Wall Damage 2May 21, 2016 12:51 am Double check that its not 50-200mm off boundary , as if its in your land; its not his fence line and he cant do anything to your property without your permission, but if it's actually on boundary line then , check with your local council. Re: Shared Boundary Wall Damage 4May 21, 2016 12:03 pm Oh gosh, this was my worst nightmare when we were looking at fences, our lounge wall is 200mm off boundary and our fencing company initially didn't want to fence this section. Hope there is something in your favour. Our garage is 150mm from boundary but insisted our fencer put up the fence anyways. Best to do so. Hope things work out with your neighbours. As for your neighbour saying they can do what they want to a "fence" - yes they can - as long as you agree that they can. No agreement then they have to rectify at their cost.
