Browse Forums General Discussion 1 Mar 08, 2016 11:06 pm My fxxked up builder is oweing suppliers money . Now I have a security screening supplier calling me saying my builder not paying the outstanding account, so they have the right to take back their screens. Can anyone confirm if the supplier is allowed to do that? I am not the one contracted with the screening company, do they have the right take it back from my home? Or they can only chase up the builder for the money? I have moved and house is handed over. Re: Builder not paying supplier, supplier taking back stuff? 2Mar 09, 2016 2:39 am It is theft if they do. I would report the security screen supplier to the police and make a report so that the threat is on record. It is a threat and they are harassing you. There have been many instances where builders have gone into liquidation, owing suppliers large sums of money. Some of those suppliers and unpaid tradies have then gone to unfinished homes and ripped out all manner of things. This situation was also discussed (mostly on page 34) by affected home owners in the Whirlpool thread linked below. Just a warning...it is a long thread and addictive. https://forums.whirlpool.net.au/forum-r ... ?t=2087160 3in1 Supadiverta. Rainwater Harvesting Best Practice using syphonic drainage. Unless there is a defects dispute Re: Builder not paying supplier, supplier taking back stuff? 6Mar 10, 2016 9:24 pm wood bang Have hand over been done? Supplier have right to retain their goods back if builder doesn't pay. Unless there is a defects dispute I wouldn't say it's an official handover. The builder towards the later stage just slowed down and is not finishing off little jobs. But I have moved in regardless and obtained all the council approvals myself. What are everyone's official handover like? Just verbally 'we are done. Thanks and bye"??? Some sales paper work will state that the goods remains the property of the supplier until fully paid for. What has the builder got to do with his supplier making demands to a third party apart from the fact that your inglorious builder has passed on your private details including your phone number to at least one supplier? 3in1 Supadiverta. Re: Builder not paying supplier, supplier taking back stuff? 12Mar 14, 2016 11:19 am (builder finally paid off the balance after I wrote a long email giving him sh*ts) So for future forum user's reference, if this happens, does home owners just call the police directly if the supplier does enter the property to retrieve anything part of the building? Re: Builder not paying supplier, supplier taking back stuff? 14May 21, 2016 7:15 pm When the owner signs a construction contract they sign the right over to property access until handover. Their land or not they are NOT allowed on site without the builders permission. Suppliers are given the builders permission to supply materials...they can enter the site. It's a grey.....and ugly situation Being a builder is more than just having once held a hammer. It's about the trades you hire and ensuring that they give a result that meets the industry standard and the home owners expectations. Re: Builder not paying supplier, supplier taking back stuff? 16May 23, 2016 11:15 am The builder has left with some little unfinished items. I am tired to chase him up. I still owe him couple thousand dollars , but the work he left undone is more than what I owe him. He seem not want to continue anymore. So I guess that is it from him. Should I request him to send me a letter that the house is officially handed over to me? or just leave it as is. I called VBA today and they said it was a Consumer Affairs issue, the old handball. Seems like the government organisations don't want to do their job at the moment. 2 7556 The fastest thing a builder will do is bank your cheque, those systems work perfectly with lightning speed, everything else is slow burn.
