Browse Forums General Discussion 1 Oct 25, 2015 8:09 pm Hi all, In currently in the process having plans drawn up to rebuild my house (inner suburbs in Melbourne). Our site is pretty constrained, is only about 9m wide and has nearly 6m slope so it was difficult to comply with all the rescode reqs...as a result we had to apply to council for 2 dispensations for the plans. Anyway it appears our request has been knocked back, so my only option is to appeal to the building appeals board. I can't see much online about people's personal experiences going through this process. Was wondering if anyone has done this before and had any thoughts or advice to share? Many thanks. Just curious what specifically were your issues... your designer should have advised you accordingly. I had wall height on boundary issues (avg height was 15 to 40cm too high) due to slope, also had side setback issues due to the narrow block. Costs don't seem too bad it's about 180 bucks per regulation request! It's the 3 month wait that kills me... Dispensations (relaxations) are usually given where the outcome doesnt affect anyone else (neighbours, etc). If the ones you applied for were knocked back, then they probably do affect others? If thats the case, you've got buckleys chance of winning an appeal. You should appeal if you think the council made an erroneous interpretation of that code, but if you are just appealing because you are finding difficulty in getting what you want because is does not meet the guidelines, you're in line for grief.
