Contract stated Paint entire interior and exterior. Thus it is not a Prime Cost item it is a Lump sum item. If we want to change colours and if we choose 2 colours (like a feature wall and remaining walls) the charge is just over $1000 per room for 2 paint colours other than initial colour. He has given us a cost of over $5300 not to paint but as a variation cost! It is a charge. The builder claims he has the HIA to validate his claim. Anyone know case law or where in the HIA this is stated? He is a custom home builder not a project builder. The schedule for paint colour alterations was not stated before contract nor did we ask. Does anyone have knowledge of the Industry standard in regards to charges for changing colour, if any. I asked 3 painters I met on the street who scoffed at the idea of a charge let alone that outrageous amount. If i wanted another wall color it would of been over $300 a wall. I got them to leave 2 walls in just undercoat my my kids room and i will paint them once i move in. It is very time consuming painting individual walls 3. If you were to remove and credit back the one colour and do it yourself you will get hardly anything back as a credit 4. Builders charge a premium for post contract variations, which they are entitled to do BTW 5. I think the solution is to do it yourself post handover. What it tells me is that they are not interested in doing the variation and have priced accordingly. If the contract is vague and the questions have not been asked and answered formally then it hinges on interpretation of points of law. I am not a lawyer but my sense is the probability of a successful outcome is not high. Lawyers costs and court costs alone will be more than what it costs to do it after handover. just my 0.02. Once handed over, either repaint yourself, or hire a painter to do it for you. It will be considerably cheaper. Your builder is not the only one to make all their money out of variations. Also, remember, they may want to use you as a reference. Bad references go a long way these days. So many builders want to build you a house, whereas, you want a home. i.e. something you want to live in and call your own. Unless there were unforeseeable issues with the site, I dont think you should have to pay for contractors errors or poor planning.
