Browse Forums General Discussion 1 Aug 23, 2015 10:39 pm Can anyone offer advice please. I purchased my land in May 2013. At that time, it was made clear to all purchases that there was to be no subdivision of the blocks as the maximum lot yield according to the Development Control Plan had been reached. In addition, the number of lots less than 400sqm also had a maximum allowable that was also already reached. The lot behind me has since been resold and the developer is subdividing into three lots. Council is about to approve this. Despite it being against several of the guidelines in the DCP. Has anyone ever come across anything like this before? Any tips on what I can do? It is already going before the council's Independant Hearing Ttibunal but council is supporting it. I just can't believe what some people can get away with. Even after they have been investigated by ICAC for questionable council dealings. Disgusting!!! Re: Help! Council trying to subdivide against their own DCP 2Aug 24, 2015 1:57 pm What size is the lot being subdivided? How does it compare to the average size there? ITs simply a matter of reading the DCP to establish what can and cant be done. Have you done that? Re: Help! Council trying to subdivide against their own DCP 3Aug 24, 2015 2:59 pm Hi, The DCP does allow for smaller lots but only 25% of the whole estate and they have already been allocated. There is also a maximum lot yield identified in the DCP and the allocations are exhausted. Council does not appear interested in complying with their own DCP. Very frustrating. DIY, Home Maintenance & Repair I'm in WA and our sandy soils make drainage a bit easier but this is what I'd be doing. Dig down to your footings and let the wall dry out.
