Browse Forums General Discussion 1 Jul 31, 2015 5:35 pm Hi, We are building with GJ Gardner Swan Hill (FYI, big mistake) our completion date was yesterday, and as far as I can see I think theres still a solid week of work left. My partner went into the office today to query a few things, and whilst there he enquired about the penalty for going over the completion date. he was told there is no penalty. I don't think that's right, I don't remember there being a clause in the contract - we signed the contract nearly 18months ago, so ive forgotten lots of things. Im going to ask for a copy of the contract - as I don't have a copy. (this doesn't seem right either) whats the "normal" or "standard" penalty. surely there must be one? or whats the point of having a completion date??? Delays resulting from client changes, etc 4. Delays in certification,etc AFAIK there is no fine print, but the builder should have told you that beforehand Designer,Engineer (Civil,Const & Envir),Builder,Concrete & Masonry Contract.Struct Repairs Re: compensation for over-due build 5Aug 02, 2015 12:24 pm If a week's delay is the biggest problem you had with the builder, I'd say you had it very good. I'm not sure about you but the cost of pursuing a few hundred dollars (if that) will likely exceed its benefit. Re: compensation for over-due build 6Aug 03, 2015 8:56 am thanks guys, no unfortunately jas0nt its not the only problem we've had with them... but just another thing to add to the list of things gone wrong. It just rang alarm bells when they said that to my boyfriend, because It didn't seem right. i have zero trust in them, as i have suspected them of being untruthful on other occasions also. eg, tiles were 3 wks behind schedule. when I enquired about it, I was told that they were being "shipped from overseas" which is why it took so long, and then they were "stuck in customs" when they finally arrived, stamped all over the box was "PRODUCT OF AUSTRALIA" "MADE IN AUSTRALIA" and the mailing address from which it came from was Dandenong VIC. I just received a PDF copy of my contract (which I shoulve already had a copy of), and It does state that the sum of liquidated damages is $0.00/per week ... nothing I can do now, but wait. Re: compensation for over-due build 8Oct 30, 2017 12:25 pm We are in the same boat building in swan hill with Gj gardner we have issues we now have wrong colour brick grout it was meant to be light grey it looks mustard orange that we invisoned showed picture from the start we just have to get over and move on our doors were painted black and not shale grey a new roller door had to be ordered to match which was an issue for them we paid extra for all matt blk tapeware which apprently laundry isnt included i assumed thats a wet area any way we still havent done a walk through we were meant to have keys last week on our completion date its very fustrating when u organise everything around the date given im getting more and more angry the days go on Hi everyone, Looking for some advise.
