The scope of works what; Removal of old deck, scree substrate to give correct falls, waterproof and tile. The cost was $9k. The area is approx 25sqm. Just over 4 years later the waterproofing has failed and water is leaking into our bedroom below and has damaged approx 4sqm of ceiling. We had a contract with the builder, and the signed contract has the NSW fair trading statement about warranty being for 7 years. The phrase in the statutory warranty paper work I refer to is "the work will result, to the extend of the work conducted, in a dwelling that is reasonably fit for occupation as a dwelling". I am going to talk to the builder but I'm confident I'll get a negative response on rectifying the issue (my experience has not been great generally so far in Sydney so I'm a bit beat down). What do you believe is reasonable to expect under the statutory warranty? Is the builder able to just say he's not willing to do anything, and if so I have to go down the fair trading path (which I've been down before for other work on our house). Is he responsible for rectifying things at no cost to me? Would that also include the ceiling which now needs to be replaced? Would greatly appreciate any thoughts or experience you have.
