Browse Forums General Discussion 1 Feb 26, 2015 9:34 pm Hi all, My name is Ryan have been looking through the forum over the last couple of days and this is my first post. Anyways I have a 1 1/2 acre block in victoria (20 minutes or so out of geelong to be correct) in a rural area and am planning on building a new house this year. Now finding a decent house design for a suburban area i like is fairly straight forward but finding one through the big companies to suit the country is tuff due too limited "ranch style designs" . Have finally i think found a design i really like by one of the big builders in the geelong region. Now after talking to alot of freinds ect... in or around the building trade they don't really reccomend the company to build my house due to various reasons (mainly quality/finish). I am planning to put a 30x15m garage on the property also so with the cost of the garage i don't plan on moving anytime in the near future so the house must be up to scratch. Now this is where is gets a bit tricky maybe maybe not? Can i legally in victoria use a companies house design if there is a certain percentage of the original design changed? Obviously i dont want to build a house then have to do something crazy like rip it down!!! There have been several posts on this topic over the last 1-2 years, have you used the forum search facility? Stewie D is one of the forum's most positive contributors and he has previously posted sound advice and several good links on the subject. If you copy large chunks then you will increase the risk of detection. It gets much tricker when you trawl through 100s of designs and then draw your own recalling on your memory for the bits you liked. I think there were cases where copyright was infringed because the foyer and stair well were copied exactly from a design. IIRC it was a herring bone staircase. We took bits and pieces from about 8 different plans from various builders. Re: Copyrights on house design rules and regs 9Mar 01, 2015 10:00 am I'm not an expert just another person building their first home, but you need to think about what this will achieve and how you will go about it. If you want a plan to your specifications, pay the extra and have your own home drawn. If you want the house "up to scratch" this also includes the orientation and design just right for your block. For example, our block faces west in the back yard and typical wisdom would say a standard plan minimises windows there. But a unique feature of our block is very large mature trees, some bush in the reserve at the rear which provides very heavy natural shade from any heat. So we wanted windows as its the best view. How do you plan to modify the design, anysay? You still need to pay someone to draw it up. May as well start from scratch. If a designer or builder is willing to pinch a design they don't own, even modified then you have to question what attention they will pay to your build. Discuss features of plans you like and you will find a quality architect or designer will come up with something even better. We've taken it to a few building companies, some won't touch it, others have had no problems There's a lot of similarities between houses of different project builders, and I'll bet even if you take your plans to a project builder, even if the house is primarily one of their own designs, but with modifications, they're likely to say no to what you want, at least until you tell them it is basically of one of their designs.
