Browse Forums General Discussion 1 Feb 18, 2015 10:26 am Hi fellow members, I met a sales person from PD last weekend and asked if the designs are approved by council, to which he said yes. Being PD, should I blindly trust him and proceed? Is there any way to find if a design has been approved by council? Who is the best person to rely upon? He also explained that once the contract is signed after colour selection meeting, the design is once again sent to the council for re-approval. Well, I am pretty clear that I won't be making any structural changes to the design. It will only be cosmetic changes/upgrades. Can council still reject the design? How much time does it take for re-approval? The land we were talking about is due to be titled in July. So, how does council approve a design on an untitled or unreleased land? I started off with Metricon and Dennis family homes and did not hear good reviews about them. I also met sales people from Carlisle homes, and others but did not find convincing. Then I met PD guys and they looked pretty convincing. Well, I will have to lock contract with someone otherwise I would never be able to build one. It's not about trust.. it's about being aware that sometimes these things are not exact.. things get delayed by a wide variety of things. It depends a lot on what the condition of your land and surrounding land is in to begin with, the weather, the efficiency of the developer that is clearing and preparing the land, council requirements and so on. I'm sure Clarendon Homes, our builder, would have loved for our land to be registered on time at the time they were advised by the developer but it simply didn't work out that way. It's not uncommon apparently. We're first home builders too.. so I thought I'd make you aware of that. Plan for July just the same.. but try not to be too disappointed if July comes and goes without land getting registered. One more question in relation to that, suppose I pay the initial deposit of 5% assuming the land will be titled in July and unfortunately, it doesn't happen till say next 4 months. In the meantime, the price of land increases. Am I bound to pay the inflated price or I would still be entitled with the older price as per the contract? Apart from that are there any such clauses or those "condition apply" things that I need to take care of? I say generally speaking because developers have some s n e a k y stuff out there, but your price should be safe There are out clauses for you if land isn't registered within a specified time also. Also if you were to sell your land to a developer they usually sign a contract with you for a certain price, but either put a long settlement (years) or settlement time is based on other developments or stages in the area. And guess what, they get in early, years ahead to secure your land at a low price before the soon to come infrastructure increases the price. This way they lock in a low future price on your land It is common that land registration runs later than the planned dates the salesman dish out. There can be many reasons for this, it's not usually the developer stating false dates to begin with.
