Browse Forums General Discussion 1 Feb 16, 2015 5:33 pm Hi all, Need some advice... Our lot and our neighbour's lot is separated by a limestone retaining wall. We are building our garage wall on a zero lot boundary, which means that one wall will sit on the limestone retaining wall. The developer has erected the neighbour's fence even though they approved of our plans with part of the garage wall on the zero lot boundary. Now part of the fence needs to be removed to accommodate the building of the garage wall and the developer has denied any responsibility. The builders have advised that this will be an extra cost item for us. I'd like to find out if it was reasonable to assume that since the developer approves of building plans, they should already know that our wall would be built on the zero lot boundary, and therefore not build the neighbour's fence the whole length? Or is it the responsibility of the home owner to bear the cost of the fence removal? We have this, albeit only about 50cm of fencing as we have a brick wall abutting the boundary, onto the limestone retaining. Now that the exterior is finished we are responsible for putting it back so the neighbour can have some privacy in his back yard.
