Browse Forums General Discussion 1 Feb 16, 2015 8:06 am Hi All, I have recently received an enquiry about the jurisdiction of NSW Civil & Administrative Tribunal (“NCAT”) formerly the Consumer, Trader and Tenancy Tribunal (“CTTT”). In short, NCAT can hear and determine applications lodged by home/building owners concerning residential building work up to the value of $500,000 under the Home Building Act 1989 (NSW). “Home building” refers to any residential building work done by a building contractor or tradesperson, such as the construction of a new home, building of an extension to an existing home, installation of a swimming pool or a renovation of a bathroom or kitchen. After lodging an application with NCAT, you can expect a first hearing within 6 weeks for matters concerning claims up to $30,000, or 8 weeks for matters concerning claims over $30,000. In that sense and when compared to Court proceedings, matters are heard ad determined quickly in NCAT. However, before deciding whether to commence proceedings one ought seek legal advice on, amongst other things, prospects of success and the most suitable forum (ie NCAT or Court) to commence proceedings.
