Browse Forums General Discussion 1 Feb 10, 2015 9:24 am Dear All, Just a short note on the key amendments to the Home Building Act 1989 (NSW) brought in by Home Building Amendment Act 2014 (NSW). On 10 December 2014 it was proclaimed that amendments to the Home Building Act 1989 (NSW) relating to statutory warranties as contained in the Home Building Amendment Act 2014 (NSW) will commence on 15 January 2015. Those amendments have the likely effect that some defects previously covered by a warranty period of 6 years will be covered by a reduced warranty period of 2 years. In light of the amendments, building owners who believe they may have defects in their buildings ought to consider taking steps to if possible avoid being time barred from relying on the statutory warranties. Of course each case turns on its own facts and circumstances, please contact me directly for examples that help to illustrate our understanding of how the amendments to the Home Building Act may operate on the timing of bringing claims against building professionals arising from the contravention of statutory warranties under section 18B of the Home Building Act. If you require any further information, please do not hesitate to contact me.
