Browse Forums General Discussion Re: Variations 7Jan 16, 2015 12:10 am There will always be a builders margin or there may be no builder for much longer What you need to establish is not if its there or not, but if it's actually reasonable or not. If it's unreasonable it's fairly safe to say is indefensible. The variation is not in the contract yet so test them out, get another quote!! If it's structural and you can't get someone else then it's going to come down to how much you want to argue, and how much the argument costs!! Re: Variations 8Jan 16, 2015 5:17 am Thanks guys. Yes I'm happy to pay them their margins. To clarify if I said a credit was say $1000 but to put it back was $4000. That's the quantum we are talking. And because of this the builder has just said for me to deal direct with tradies now as an option. Anyway I just wanted to know if there was anywhere legally that said if they take it out at "X" they can't charge you "5X" to put it in. Re: Variations 9Jan 16, 2015 6:37 am There would be nothing like that at all in the contract. In my hia contract, if we raise a variation to remove something from the contract, the builder is entitled to keep the markup. Once a variation is signed to remove something, it's agreed upon and the item is gone. If you decide to add it back later, the builder has every right to requote this item at a higher or lower price as they see fit. It's then up to you to decide if you wish to accept the variation. Re: Variations 10Jan 16, 2015 7:18 am We had the same issue with PD. Instead of changing the location of an item they 'credited' us and then charged us again. The price they charged us was MUCH higher than the credit back. So we ask to relocate it and they accepted. Hope you get it all sorted CrazyK. Re: Variations 11Jan 16, 2015 7:20 am Unfortunately it looks like I'll loose my battle. I don't need the money from the credit so will get them to leave the item in and work out what I'm going to do in the other part of the house. It's the whole principle of it that annoys me. Sorry to hear this. It's a shame the builder is not playing ball. Maybe it's technically not illegal but you'd think morals would kick in... Good luck with the build. Re: Variations 14Jan 16, 2015 8:17 am Crazyk Yes I would of thought so. Just means I won't be as forgiving on defects I would of not worried about otherwise. That's exactly how I would deal with the situation. It seems very clear to me that your contract states that a security account does NOT need to be established so the answer to the builder is NO. If in doubt find a contract… 1 8505 The fastest thing a builder will do is bank your cheque, those systems work perfectly with lightning speed, everything else is slow burn. Just the way it is. 1 8706 Can someone please offer some advice? Im DESPERATE. Because I'm completely and utterly exhausted. How long are variations taking with other companies at the moment? We… 0 18470 |
