Our project should have been finished but now he is still mid stage and fixing a big list of defected items! Now he tells us he is going away for holidays in January. His contract ends in January (date picked by him!!!!). Obviously we are not happy that a project that should have been finished is still not at lock up stage due to poor workmanship and now he is off on holidays. His holiday period is not stated in our contract and he has had no grounds for an extension of time. Our contract also does not state any set liquidated damages for going over time, just wondering if we have any options here???? or is there any default rate for going over time???? especially when it is all to do with his own quality of work and decision to go on holidays now? When you say your contract does not have any set liquidated damages, do you mean that clause was not included or there was no amount put in? I believe that in some states there is a base amount but it depends what you signed off in the contract. You should probably get legal advice. If you are still looking at a few more months of time for the building works to be completed, you need to sort this out soon. I hope you have a building inspector checking on the work. You might also consider contacting your Department of Fair Trading or Consumer Affairs for advice. A letter from a lawyer may help. Most builders go on holidays from Christmas week to February/late January. You could also consider terminating the contract, which would require legal advice and being careful how things proceed.
