Browse Forums General Discussion 1 Nov 05, 2014 12:54 pm Hi all, We singed a NSW fair trading contract early this year the finish date on contract is Mid June still not completed. At the time of signing the contract we have no idea about liquidation and NSW fair trading contract doesn't have it either. Soon after the slab was poured builder had serious cash flow issues he demanded money upfront or advised us the build will be delayed. Like an idiot i believed him and released the funds upfront out of fear(my bad). For doing such a thing he promised that he will do some extract in the house like bulk heads etc. Now at the last payment he demands more money stating that all the variations that he done for me. Initially his cost of variations were around 20k. We had discussion , he and myself agreed on 14,000 and he promised he would finish the house in few weeks. A month later he come back saying the same variation cost him 40,000. Demands more money. At the moment our house is incomplete and he is not doing anything about it. What options i have ? If i terminate the contract and finish the house by myself who will give warranty? Engage a solicitor. Do not do anything further except get proper legal advice. Your builder has engaged in - taking your post at face value - unethical and illegal behaviour. They are not entitled to claim money in advance. They can not blackmail you in order to get money in advance. Do not pay another cent until you have taken your contract and all paperwork to your solicitor. Variations to a contract should come documented with costs and require you to sign off on them to agree before he proceeds. He can't then retroactively change the value of the variation and stick his hand out for more money. If what you say is true, then you've been taken for a ride and you need legal assistance asap. You need to take all documentation to your solicitor ASAP. If any communication with this guy has been through emails then you need to print those out and take those too. Letters, recorded messages etc etc as well. The more info your solicitor has regarding the sequence of events and all correspondence then the better your legal case.
