I am currently in the process of feasibility for a knock down rebuild in the inner north suburbs of Melbourne, and am working with a challenging narrow/sloping block around 9m wide. Whilst I realise it's technically possible to build completely within rescode regulations even on a tight block like mine, it's quickly becoming clear to me that to maximize use of the land and get a nice sized house that we are happy with I'll need to build slightly outside of rescode for some side setbacks and possibly height restrictions. (Not over the top). Town planning doesn't apply to my block, only need a building permit I've done some research and spoken to the local council, and they have advised that the report and consent is a bit of a grey area...They may or may not approve these dispensation requests, irrespective of having neighbors permission or not. So its a bit of a catch 22 where I need to pay for plans to be drawn up for council to review with no guarantees of the outcome. Anyway one of my neighbors is completely convinced that she won't sign anything (old school old lady), however the other side neighbor is very relaxed and happy to sign/support us as required. I'm in two minds about the process and to be honest it has me concerned as I'm not feeling confident. Any words of wisdom would be appreciated! Thought it would be good to share experiences about building outside of rescode/dispensations as I couldn't find an existing thread on this. Thanks Chris Re: Report and consent / dispensations : share stories 2Oct 13, 2014 3:48 pm You need someone to draw your plans that is au fait with your local council, their guidelines and restrictions not someone from the other side of town - whether you use a draftie, building designer or architect. Even then it may be a 50:50 proposition to get it through on the first go. Sometimes the councils and their town planners like to justify their existence by knocking something back . Slightly modifying the plans for the second attempt sometimes has the desired effect. We are in a similar situation for our plans that are going in soon. We are slightly over the side boundary envelope and hard surface area. Writing a comprehensive SEE ( statement of environmental effects ) and finding similar examples nearby that exceed their guidelines that you can refer to is a step in the right direction. I've started looking around at houses in surrounding streets and can see about 5 that have done what we want to do. One of the main things is having the 2nd storey the same width as the ground floor, to maximize the width of the block. I can see examples of a few others that have done this... Even though councils differ in what they require, a lot of the SEE aspects are very similar - floor space ratio, max building height etc. What other houses have been able to get passed by your council with respect to similar conditions is important because it sets a precedent and makes it a lot harder for them to knock back yours.
