He informed them that if they could get there private certifier who has done the original wall and house to sign off on it then it's fine. The private certifier dosn't want a thing to do with it and have been very helpful towards me, so the council will be now formally preparing an order for him to remove it as they also believe it is dangerous and cannot support a fence installed on top of it. The only bad news is i'm likely to never see a fence in the near future as the guy dosn't have a time frame in which a wall must be built. Hi Welby, He won't have a time frame but the council building will which he willhave to comply with. Just keep the pressure on council once the order is issued. I also can't seem to find any interim occupancy certificate for their house either listed on the council development tracking website. I could really make this guys life difficult if they don't have one i'd imagine. Building the Lawson with Eden Brae in Cameron Park Re: Neighbors retaining wall 14Nov 01, 2014 1:14 pm One thing I noticed from the pictures posted is that you neighbours driveway is reasonably close to the wall. This changes a lot of things. Any added weight above the wall is called a surcharge. Parking lots, swimming pools, driveways, and vehicles parked on driveways are common surcharges. Here is a picture to give you an idea. http://i459.photobucket.com/albums/qq311/EB_Photos_2009/Surcharges.jpg The additional load of the driveway and the potential weight of a vehicle being parked on the topside of the wall (where his trailers are positioned in your pictures) must be addressed in the construction method of the rest of the retaining wall. Your neighbour will most likely argue that he will never park a car there so the wall doesn't need to be engineered. Your picture already sets the precedent in this case that if the area is suitable enough to position 2 trailers, then over the lifetime of the property how can your neighbour guarantee that a vehicle will never be parked there. There are Aus standards for this type of thing and the Development Planning Controls as set out by your local Council will also have some sort of reference to Retaining wall surcharging regs. my 2 cents. There's been a few heated arguments and i'm the bad guy for going to council apparently. Anyway will update again if anything else happens.
