The complaint went to VCAT but I wasn't asked to attend and give evidence. Naturally I was curious to see how my client fared and I called him. He was ecstatic. Not only did he get the judgment but also got it for the full amount of the claim. But wait there is more. He also got the costs of my reports awarded against the builder. Not bad. The successful party, can make application for costs incurred in bringing the case to court, right down to the court application fee. If the respondent wins, he /she can do likewise. You are right about court but not VCAT In VCAT each party bears its own costs however there are circumstances in which costs can be awarded but is by no means automatic.
