Browse Forums General Discussion 1 Aug 14, 2014 6:45 am Recently I prepared a report on failed inground fibreglass swimming pool The problem with the pool was that soon after construction it heaved around 40 mm at corners + there were workmanship problems with rough sandstone paving, brick water feature was not on the plan and did not have a footing. The cause of heave was plumbing leak that allowed water build up on outside of pool shell and caused swelling of foundation and uplift I argued successfully that the pool was defective in design and construction because it did not have foundation protection in the form of a sump with automatic float pump that would keep excavation dry and prevent catastrophic damage from a build up of water in foundations and because it leaked. I recommended full demolition and reconstruction and provided a cost estimate Builder's insurer commissioned engineering report but it essentially agreed with my recommendations Builder did not put up much of a fight and none of my recommendations and estimates were challenged Owner was awarded full cost of demolition and replacement of heaved fibreglass swimming pool including surrounding sandstone paving. I so wish you were on our case an tribunal. Please keep fighting for people like us. I agree why let yourself be publicly dragged through the mud...do the right thing, pay up and walk away. I am sure some arrogance or delusion tells them they will win. Good to see times are a changing! Let's hope NCAT follows.
