I have bought a new house and during the sale period a new fence was erected, the old owner paid for it but its a mess, this is what he calls a retaining wall, the neighbours land is the height of this wooden thing and the gap will allow all water and mud to flow straight into my place, also the fence has been moved onto my boundary and as you can see it is on top of my mains water pipe, the fencers removed parts of my concrete tree boarders to build on my side and there huge gaps under the fence in some places where more dirt can come through the fence. I saw fencer today and he said he did what he was asked by the previous owner and i said i dont think they would have told you to moc\ve the boundary and damage the concrete and put the so called retainer wall on top of my water mains pipe... im soo angry, he said hes not going to do anything if the ex-owner is happy with it, well of course the ex-owner wont care... where do i go from here, he did say he will give the neighbour my number and we can discuss it. should i go to council and get them to look at it ? [img][img]http://i130.photobucket.com/albums/p270/daff06/th_fence1.jpg[/img][/img] Re: Would you be Happy with this Fence?? 3Jun 02, 2008 9:04 pm yes paula, settlement was last monday, when i picked up the keys i told the agent i wasnt happy with it and she was going to get the fencers nunmber for me, she didnt but i spoke to another agent for the same place and she gave me his name & number. my partener thinks i dont have a leg to stand on as i didnt pay for it, but its such bad workmanship surely he cant get away with it... Or alternatively the council or your water company? There has to be something that can be done.... it looks terrible and can't be legal can it??? Good Luck, i hope you can resolve it soon!!! Re: Would you be Happy with this Fence?? 6Jun 02, 2008 10:32 pm i know phoenix its so ugly here is another pic of up further, i will give the fencer the rest of this week to think about it then i will ring him and if no good shall contact council, im seriously thinking of doing that tomorrow as his attitude sucked, typical of some tradies with dealing with a woman, i wondered if i can get a council rep to do a survey and write what has to be done and then show the fencer, but as i didnt pay for it im not sure how i stand yet...Ive looked forward to having my own house for so many years that i didnt need this, but thats life so fingers crossed i suppose

A bad one that you will have to learn from. IMO - Basically the fencer has been paid, you now own the house and the fence is on your land - so the council is not interested in any of your issues with a contractor - all be you did not employ him as such. I'd be working a plan of how to rectify it in the future and don't loose any more sleep over it - because that won't help fix it - and it only makes you feel worse. Look around at all the good things you like about you new house. Hey i might be pulling at straws here, but i hope thats the case and they have to have it moved!!!

Re: Would you be Happy with this Fence?? 9Jun 02, 2008 11:06 pm yes steve, i think your right about getting over it, im trying but its hard as i just want it fixed, i had been puting it out of my mind but today he was so rude and its such a mess that im peed off, here is the final pic i shall post showing more of the mess, this shows the fence sitting on my tree border with the sharp edge hanging over and a nice gap... I really do love my house and besides this glitch i have loved the feeling of it, it is just meant for me, i shall post some reno pics in other topics

Up to the meter, access to the water pipe is the responsibility of the watercompany. If they cannot get to the pipe to carry out maintenance or replace the meter, they will rip up / dig up what ever they need to, at your expense. If there is a legal issue with the placement of the fence....i.e. the contractor has not installed the fence properly doesn't the "warranty" on the fence transfer to the new owner. If there is a nuisance issue with mud coming under the fence can you talk to your new neighbour about it. It's not the best way to move into the neighbourhood but it's another approach.
