If there is a legal issue with the placement of the fence....i.e. the contractor has not installed the fence properly doesn't the "warranty" on the fence transfer to the new owner. If there is a nuisance issue with mud coming under the fence can you talk to your new neighbour about it. It's not the best way to move into the neighbourhood but it's another approach.
