Who's responsible for asset protection of footpaths and driveways during building works?
Is it the builder or owner?

The last time I built with a standard HIA contract there was a clause in the contract that made the builder responsible (see http://www.anewhouse.com.au/2013/01/contract-docum…vehicle-access/ ) Since then I have heard of Building Contracts where this type of clause has been removed making the owner responsible for any damage. The demolition contractor whom made the demo application to council is responsible until the demo is complete. Unless you are a owner-builder, you are NOT responsible for any damage at all. We could not get the money back until council officers were satisfied that nothing had been damaged. There were problems with stormwater discharge and that meant until we had that fixed we could not get the money back. I would say that the client is the one who is responsible for the footpaths etc as they are the ones who put up the bond, well in Vic anyway.
