Browse Forums General Discussion 1 Jun 06, 2014 3:38 pm Hi, Im having issues with my builder and need some advice as to what i can and cant do. I designed my house the this particular builder and have signed the building contract and finalised everything with the bank. I gave the builder about a month to sort out the plans with the council for approval which i then called to see how things were going. He hadnt even sent the plans to council by this point which was frustrating and added further delay to the build. I have now spent the last 4 weeks calling and leaving him messages to which he replied once saying hed call me back after the meeting he was in. I am still waiting for his call. I have no information on where we are at. I cant get through to him nor can i get any answers. These extra delays are putting me in a sticky situation financially and considering i have signed a contract i cant just walk away. Apart from leaving countless messages to call me back what else can i do?? Mick Re: Builder Issues 2Jun 06, 2014 3:49 pm Go and see a solicitor and get advice as to whether you can get out of the contract you have signed (there should be non-performance and other such clauses in there). If a builder is causing delays and not getting back to you even before construction starts that's a very bad sign! Re: Builder Issues 5Jun 06, 2014 6:29 pm Have you paid a deposit? and how much? Legal advice will probably be helpful but will cost from about $300 per hour. Stop ringing the builder and start communicating via mail through registered post, stating your issues so that there is a record of your communications. Also contact your bank to ensure that no further payments are made to the builder. See if you can find previous court cases for the builder (In Vic it would be VCAT cases) and also do a good google search to see if other people have had similar problems to you. Have you been given a completion day and have you signed an amount for liquidated damages? What does your contract say about time delays? Your state Consumer Affairs or Fair Trading Office may have some free advice for you. If you are getting warning signs now, it may be cheaper to lose your deposit that continue on with the build. I know someone who got warning signs, same story as you - plans not at council, nothing being done, calls not being answered - their renovation was never finished and the builder ended up abandoning the renovation. It would have been cheaper for them to lose their $8,000 deposit that to have continued with that Builder.
