We entered into a contract with a demolition company called DemoCorp at end of Oct 2013, and agreed with a price of $11866.8 (including GST) for them to demolish a property in Panania. The quote was provided after they inspected the property. We signed the contract then paid $1000 deposit at the time, and the price on the contract is valid for the following 6 months. Mid March 2014 as the DA was approved, we contacted DemoCorp again to start the work in early Apr and was asked to pay another $1000. We paid, waited and waited, and the job was pushed to later and later. On 28th Apr, the demolition still hasn’t started, and we were informed that DemoCorp want to charge us an additional of $2500 + GST. They claimed that there were a lot of abandond furniture in the property, the grass was overgrown, and there has been additional asbestos identified. We however believed not all their claims are reasonable, as they went to inspected the property in Oct 2013 when we asked for the quote. The status hasn't changed much since then (first , now one is living there and we periodically visit the property to keep an eye on things). We think it's unfair to charge us more, and DemoCorp is taking advantage of us not wanting to delay the work. We asked if we do not do it with them anymore how much can be refunded, and they only agreed to refund $350 (out of $2000). Here is the main part of email from them: 1. The inclusions for the additional charge of $2,500.00 plus GST are as follows; a. Removal of asbestos sheeting under external cladding to house. b. Removal of asbestos sheeting from walls and ceilings to all rooms in house (excluding bathroom, laundry and kitchen which have already been allowed for in quote). c. Removal of all rubbish/debris within house, shed, under carport and throughout yard. d. Slashing of overgrown yard to allow for access around house for asbestos removal. e. Allowance for works to be carried out same time as demolition. f. Disposal of all asbestos and rubbish debris to licensed landfill or recycling yard. Should you wish to proceed with the additional charge, please complete, sign and return the attached quote acceptance so we can continue with the demolition. 2. Demolition costs incurred so far are as follows; a) Temporary safety fencing setup and rental $495.00 plus GST b) Electrical disconnection $295.00 plus GST c) Council/Private Certifier documentation $500.00 plus GST d) Standown crew onsite 23/04/2014 $360.00 plus GST I wonder, if this kind of thing is normal and reasonable? Quote may be valid for six months, but that is for takeup. Once you have an agreement, the quote is valid for that job irrespective of completion date. 2. The demo Co is out of line asking for additional costs, unless it is a periodic payment agreed to in your contract. They inspected and quoted, so they have to stick to their quote. If they underquoted, it's their problem, not yours. 3. Abandoned furniture? Long grass? Pffft...are these clowns serious? The costs they gave in your point 2 seem reasonable. But you could have disconnected the electricity yourself. I dont know what a stand down crew is, but it seems the demo Co has incurred $1300 cost, and you've paid $2000, so tell them to proceed and you will make periodic payments as agreed in your contract. The contract should spell out both parties obligations, and thus you should know where you stand after reading it. I am looking for someone who might have tackled a similar issue as me.
